    On 15 February 2011 Parliament of Ukraine adopted amendments (the "Amendment") to the Law of Ukraine "On Banks and Banking Activity" (the "Bank Law"), establishing new rules of acquisition of substantial interest in the banks (the "New Rules"). Under the New Rules, acquisition of at least 10%, 25%, 50% and 75% of shares in a Ukrainian bank by a legal entity or individual requires 3-months prior notification of the relevant Ukrainian bank and the National Bank of Ukraine (the "NBU").

    The Verkhovna Rada, Ukraine's parliament, has adopted the new version of the law on amnesty in Ukraine. A total of 309 MPs voted to pass this law on Feb. 17, 2011.
    According to the law, the amnesty is declared by the amnesty law, which, in turn, can provide for a relief from serving the punishment (a complete amnesty) or a partial relief from the sentence (partial amnesty).

    European or other ex-U.S. judicial or arbitration proceedings can relatively easily obtain discovery in the U.S., of the same scope as if they were in a U.S. court, without the inefficiencies and limitations of the Hague Convention.  Recent decisions by two federal appellate courts have confirmed this, and their authorative decisions will likely promote and ease the use of the statutory option in the future. http://www.ratnerprestia.com/221?article=401

    Magisters, a leading Ukrainian law firm, raided by prosecutors
    Ukrainian prosecutors on Feb. 3 conducted a 14-hour search of the central office in Kyiv of Magisters, a leading Ukrainian law firm.
         According to a statement issued by Magisters on Feb. 4, at 1:30 p.m. on Feb. 3, around 30 armed men and investigators from the General Prosecutor’s Office stormed the headquarters of Magisters located in downtown Kyiv at 38 Volodymyrska Street. Magisters said prosecutors detained the firm’s 50 lawyers and staff for six hours. The firm said “one pregnant employee was urgently rushed to hospital by ambulance during the raid.”

    Kucinich Sues House Cafeteria for Olive Pit Injury
    Former presidential candidate and U.S. Rep. Dennis Kucinich, D-Ohio, is suing the U.S. House of Representatives cafeteria for selling him a sandwich wrap in 2008 containing an olive pit that allegedly caused oral injuries. The lawsuit, filed in Superior Court for the District of Columbia earlier this month, seeks $150,000 in damages from the companies that operate the House cafeteria for selling food that was "unfit for human consumption" that Kucinich claims caused "significant pain, suffering and loss of enjoyment."

    More than 5,000 attorney positions were eliminated last year undefined a downsizing greater than the legal profession has seen in the previous 30 years, according to a National Law Journal report on a survey of law firms throughout the country. Competition for the few jobs available has remained extreme as employers often receive resumes from hundreds of well-qualified attorneys for one position.

    Tax Code of Ukraine Will Have Oil and Gas Producers Tightening Their Belts

    The newly adopted Tax Code of Ukraine ("Code"), effective starting 1 January 2011, has significantly increased royalty payments and charges for subsoil use. Royalty payments rise approximately 16 percent for natural gas and almost 29 percent for oil and gas condensate. Charges for subsoil use increase approximately by 66 percent per ton of oil and gas condensate and almost 90 percent per 1,000 m3 for natural gas.
