    In what seems to be a ping pong match between various courts in Ukraine,  Ukraine's High Administrative Court has ruled that former President Viktor Yushchenko illegally bestowed "hero" status on two Ukrainian independence leaders from the World War II era, RFE/RL's Ukrainian Service reports. The ruling in Kyiv on August 2 supports verdicts by two lower courts in Donetsk that Organization of Ukrainian Nationalists leader Stepan Bandera and underground Ukrainian insurgent army head Roman Shukhevych should not have been designated "heroes" by Yushchenko in 2007 and 2010, respectively.  Детальніше-Read More at RFE/RL   As previously reported,  On Monday, July 18, 2011, Kyiv's District Administrative Court upheld a 2010 decree by former president Viktor Yushchenko that posthumously conferred the status of independence fighters on nationalist militants who were active in western Ukraine during and shortly after World War II.     On June 17 2011 Parliament approved amendments to the Production Sharing Agreements Law that would reintroduce a stabilisation clause which previously received a presidential veto in 2010. The amendments came into effect on July 14, 2011. Детальніше-Read More Asters Law Firm

    The class action litigation instituted by Yulia Tymoshenko against Firtash and RosUkrEnergo in the Southern District of New York has recently had an unusual twist. A Massachusetts corporation has requested to intervene in the litigation with a claim against Tymoshenko. The Counterclaim is for collection of the judgment entered by the U.S.District Court for the District of Massachusetts on July 7, 2005 and registered in this U.S. District Court under 28 U.S.C. §1963.  Plaintiff in the Counterclaim, Universal Trading & Investment Co., Inc. ("UTICo") is a corporation organized under the laws of the State of Massachusetts in 1993. UTICo is the judgment creditor for the judgment debt in the amount of  $18,344,480 against United Energy Systems of Ukraine, PFG (“UESU”), in which Yulia Tymoshenko ("Tymoshenko") was the president and whose corporate assets Intervenor claims she has put under her personal control. The judgment debt includes interest pursuant to 28 U.S.C. §1961. Tymoshenko, who became UESU‟s founder in 1995, is named as a Defendant in this Counterclaim. Intervenor claims Tymoshenko has handicapped the collection of the judgment against UESU.

    Attorneys for John Demjanjuk have filed a motion in the US District Court for the Northern District of Ohio;
     "to set aside that final judgment that ultimately led to Mr. Demjanjuk’s denaturalization and deportation to the Federal Republic of Germany where he now resides. As more fully set out in the supporting memorandum of law, this motion rests upon the persistent failure of the government to comply with orders and other unambiguous obligations requiring disclosure of discovery materials to the defense. It also rests upon what the undersigned believe support a finding of fraud on the court for a remarkable third time undefined once as previously found by the United States Court of Appeals for the Sixth Circuit, once by this Court in prior proceedings, and now the circumstances that give rise to this motion."
